A partnership, or an LLC taxed as one, with a partner who is not a US person withholds tax on that partner's share of the income connected with a US business, at the top rate, and pays it in quarterly installments on Form 8813. After year end it files Form 8804 with a Form 8805 for each foreign partner, by the same date as Form 1065. The foreign partner uses the 8805 to claim the credit on their own US return.
